Building Works Assessable Against the Planning Scheme

Specific building projects that do not change the core use of land, but fail to meet local planning rules (such as boundary setbacks, site cover, or height limits). These works require a formal development application and code assessment before a building certifier can issue a final permit. Under the Planning Scheme, where constructing a Class 10A outbuilding or Class 1A building within the Rural and Rural Residential Zone, the side and rear boundary setbacks are varied by the Planning Scheme as opposed to those within Queensland Development Code. These setbacks are as follows:

Rural Zone Setbacks:

  • Where the site is greater than 2 hectares – 10m from front and side boundaries
  • Where the site is less than 2 hectares – 5m from and side boundaries

Rural Residential Zone Setbacks

  • Where the site is greater than 2 hectares – 6m from the front and 3m from the side boundaries  
  • Where the site is less than 2 hectares – 5m from the front and 2m from the side boundaries  

Where a development does not meet the prescribed setbacks, a Building Works Assessable Against the Planning Scheme approval is required and not a Residential Boundary Relaxation.

For lodgement you will need:

  • Completed DA Form 1
  • Assessment against Performance Outcome 3 of the Rural Zone Code OR Performance Outcome 5 of the Rural Residential Zone Code of the Planning Scheme (this will depend on the zone of your property)
  • Application non-refundable fee per the FY26/27 Fees and Charges.

 

Once properly made, Council usually will provide a response within 10 business days.
