Class 1A & Class 10A Outbuildings

The Queensland Development Code (MP 1.1 and MP1.2) regulates the setbacks of Class 1A Dwellings and Class 10A Outbuildings. Where a development does not comply with the relevant Acceptable Outcome (otherwise thought of as the minimum requirement), a Design and Siting Application is required to be lodged, assessed and approved by Council.

Road Boundary Setbacks

The setback for structures is typically 6m from any road boundary for lots larger than 450m2 and 3-4m for lots less than 450m2. The acceptable setback dimension may vary depending on corner allotments and the established setback pattern within the street. 

Structures over 2m in height on corner allotments must be clear of the 9x9m corner  truncation. An open carport cannot be located within the 6m road boundary setback if there is an alternative location on the site that can comply.  

Side and Rear Common Boundary Setbacks

The side setback for structures is typically 1.5m from side and rear common boundaries however Class 10a structures (such as sheds and carports) can be less when the total building length is not more than 9m.  

The acceptable setback dimension may vary depending on the height and length of the proposed structure, how narrow the lot is, the location of existing structures on the property and the proximity of habitable rooms of neighbouring dwellings. 

*Note: Customers are to consider any sewer, water and stormwater mains in proximity and ensure compliance with MP1.4 Building over or near relevant infrastructure otherwise an additional application will be required.

 

Application Requirements

Applications must include the following: 

  • Completed Form Request - Amenity and Aesthetics and Design and Siting
  • Payment of the application fee, and  
  • Site plan, floor plan and elevations of the proposal. 

Council may have regard to the following matters in making its assessment: 

  • The corresponding Performance Outcome of the Queensland Development Code 
  • Any adverse amenity impacts created because of the proposal on the established built form and character including adjoining neighbours or public place 
  • Any underground Council controlled infrastructure and/or easements located within the site 
  • All existing buildings and structures and the established built form immediately visible from the site including building line setbacks 
  • The differences in contours of the land on which the building is proposed compared with the contours of adjoining land and road frontage, and  
  • The dimensions of the land on which the building is proposed and whether the site is a corner site. 

Once properly made, Council usually will provide a response within 10 business days.
