Local Law Amendments 2017 - Part 3

Gladstone Regional Council is currently undertaking a review of its local law and subordinate local laws and has resolved at its general meeting on 7th November 2016 to propose the following amendment local law and subordinate local laws:

  1. Animal Management (Amendment) Local Law (No. 1) 2017
  2. Animal Management (Amendment) Subordinate Local Law (No. 1) 2017
  3. Keeping of Animals (Amendment) Subordinate Local Law (No. 1) 2017

The purpose and general effect of the proposed local law and subordinate local laws is as follows:-

  1. The amendment local law regulates the supply of cats, including the publication of advertisements about the supply of cats; and 
  2. Animal management amendment subordinate local law
    a) prescribes persons for cat supply exception; and
    b) prescribes a requirement for an approval to keep animals; and
  3. Keeping of animals amendment subordinate local law
    a) prescribes documents and materials that must accompany an application for a cat breeder approval; and
    b) prescribes criteria for the grant of a cat breeder approval; and
    c) prescribes conditions that will ordinarily be imposed on a cat breeder approval.

Possible anti-competitive provisions have been identified in each of the proposed local law and subordinate local laws and Council has proposed to conduct a public interest test in relation to the possible anti-competitive provisions.

Public consultation on the above proposed amendments has opened with consultation closing on 27 March 2017.  The public consultation aims to seek input from the community to determine if the community agrees with the proposed changes.  Your feedback is sought on if your support the changes or not.  Submissions must be made in writing and should include grounds for the submission and any facts and circumstances relied upon.  Written submissions can be lodged as below:

Current Local Laws

Under the Local Government Act 2009 (Act), Council may make and enforce any local law that is necessary or convenient for the good rule and local government of its area.  The term "local law" includes "subordinate local law".

Following amalgamation of the former local government areas comprising Gladstone City, Calliope Shire and Miriam Vale Shire Councils, Gladstone Regional Council made a new set of local laws replacing the local laws of those former Councils.  These local laws commenced on the 1 December 2011.

Since 1 December 2011, these local laws may have been amended in accordance with the provisions of the Act.
