Local Law Amendments 2018

Gladstone Regional Council is proposing a new local law on Waste Management and has resolved at its general meeting held on 6th March 2018 to propose the following local law and amendment subordinate local law:

  1. Local Law No. 8 (Waste Management) 2018;
  2. Local Government Controlled Areas, Facilities & Roads (Amendment) Subordinate Local Law No. 1 2018

The purpose and general effect of Local Law No. 8 (Waste Management) 2018 is to protect the public health, safety and amenity related to waste management by—

   (a) regulating the storage, servicing and removal of waste; and

   (b) regulating the disposal of waste at waste facilities; and

   (c) ensuring that an act or omission does not result in—

(i) harm to human health or safety or personal injury; or

(ii) property damage or loss of amenity; or

(iii) environmental harm or environmental nuisance.

The purpose and general effect of Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2018 is to omit, from Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2011, provisions about waste management which are replicated in the proposed local law. 

Possible anti-competitive provisions have been identified in the proposed local law and Council has proposed to conduct a public interest test in relation to the possible anti-competitive provisions.

Public consultation on the above proposals has opened with consultation closing on 14 May 2018.  The public consultation aims to seek input from the community to determine if the community agrees with the proposed changes.  Your feedback is sought on if you support the changes or not.  Submissions must be made in writing and should include grounds for the submission and any facts and circumstances relied upon.  Written submissions can be lodged as below:

Current Local Laws

Under the Local Government Act 2009 (Act), Council may make and enforce any local law that is necessary or convenient for the good rule and local government of its area.  The term "local law" includes "subordinate local law".

Following amalgamation of the former local government areas comprising Gladstone City, Calliope Shire and Miriam Vale Shire Councils, Gladstone Regional Council made a new set of local laws replacing the local laws of those former Councils.  These local laws commenced on the 1 December 2011.

Since 1 December 2011, these local laws may have been amended in accordance with the provisions of the Act.
