Local Law Amendments 2016 - Part 1

Public consultation has now closed on the Part 1 proposed amendments and Council is reviewing the submissions received.

Local Law Amendments 2016 - Part 2

Gladstone Regional Council is currently undertaking a review of its subordinate local laws and has resolved at its general meeting on 1 November 2016 to propose the following amendment subordinate local laws:

  1. Animal Management (Amendment) Subordinate Local Law (No. 1) 2016; (link)
  2. Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2016; (link) and
  3. Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2016. (link)

The purpose and general effect of the proposed subordinate local laws is as follows:-

  1. Animal Management (Amendment) Subordinate Local Law (No. 1) 2016:
    (a) expand on areas where animals are prohibited in public places, namely extension of the Tannum Sands prohibited area and inclusion of Chinamans Beach, Agnes Water during turtle breeding seasons; and
    (b) change the extent of the dogs off leash area at Agnes Water to reduce the current area to north of Beach Marker SS1, Surf Club Avenue; and
    (c) specifically prohibit animals from Tondoon Botanic Gardens; and
    (d) amend the definition for vermin to remove guinea pigs.
     
  2. Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2016:(a) declare two local pests, Leucaena and Indian Myna birds; and
    (b) amend the definition for vermin to include rabbits and foxes.
     
  3. Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2016:
    (a) include regulation for removal of waste bins from road and footpath areas after collection of waste (previously covered in state environmental legislation); and
    (b) include restrictions for driving on Agnes Water Main Beach unless essential services vehicle, life-saving vehicle or shark control services vehicle; and
    (c) change the time period allowed to remain at Miriam Vale Showground Reserves for camping from 24 hours to seven (7) days.

No anti-competitive provisions have been identified in each of the proposed subordinate local laws.

Public Notice - Proposed Subordinate Local Law Changes

Public consultation on the above proposed amendments has opened with consultation closing on 9 December 2016.  The public consultation aims to seek input from the community to determine if the community agrees with the proposed changes.  Your feedback is sought on if your support the changes or not.  Submissions must be made in writing and should include grounds for the submission and any facts and circumstances relied upon.

Current Local Laws

Under the Local Government Act 2009 (Act), Council may make and enforce any local law that is necessary or convenient for the good rule and local government of its area.  The term "local law" includes "subordinate local law".

Following amalgamation of the former local government areas comprising Gladstone City, Calliope Shire and Miriam Vale Shire Councils, Gladstone Regional Council made a new set of local laws replacing the local laws of those former Councils.  These local laws commenced on the 1 December 2011.

Since 1 December 2011, these local laws may have been amended in accordance with the provisions of the Act.
